The £38.9M was all transferred to NHS charities. No crimes have been comitted. The fact that they had a book deal and proffed from it just shows me that they were shrewd and greedy, but not unlawful. I highly doubt anyone bought one of their books and assumed their money would go to charity, or if they did then they should not have assumed. Unless of course it was written somewhere that it would go to the charitable fund, in which case that is wrong

You are ignoring the fraudulent representation in the book itself and elsewhere that a donation from the proceeds was to be made to the charity. This was a lie and despite the charity commission twice asking them to redeem this, they did not make a donation.

That is potentially a fraudulent misrepresentation contrary to the Fraud Act.

The £38.9m that was raised by Captain Tom all went to Charity and is not relevant for the fraudulent misrepresentation point

The fact the obtained a book deal again is shrewd actions on their part and again not a crime


Their fraudulent misrepresentation that a donation from the proceeds of the book would go to the charity is however a potential criminal act.

Can somebody tell me (a) how much Captain Tom raised, and (b) how much his family is supposed to have misappropriated? Armed with this knowledge, I will decide whether or not to work myself up into a froth of indignation.
 
I guess you could call into question the £800k they made from the book sales, seeing as they were allegedly going to the fund not to Capt Tom himself. I had a quick google but couldn't find anything that said the income would go to the fund but I can't remember whether that was how it was promoted. Some of the other stuff looks like opportunism rather than illegality.
