Yeah, I think Trump knows this, so he can say "I wanted them released (because I'm obviously totally innocent), but the DoJ can't. How sad."

As I understand it, and I'm happy to be corrected and/or schooled in this; is that Donny has made his (populist) statement betting that :-
i) The senate 'll vote against the release.
ii) If this doesn't happen; he'll 'invoke' the -We can't release the files, as there's an active DoJ investigation, preventing 'us' from doing so- argument.

Happy to have the above picked to shreds.

To the surprise of no one, it looks like the DoJ prosecution of former FBI director James Comey is hanging by a thread.
A magistrate judge has issued a searing opinion about the grand jury proceedings the lawyer Lindsay Halligan took, in order to secure indictments against Comey.

The [grand jury] record "points to a disturbing pattern of profound investigative missteps, missteps that led an FBI agent and a prosecutor to potentially undermine the integrity of the grand jury proceeding,"


[The government's] "actions in this case – whether purposeful, reckless, or negligent – raise genuine issues of misconduct, are inextricably linked to the government’s grand jury presentation, and deserve to be fully explored by the defense,"


In the light of his in camera findings, the magistrate judge has permitted the grand jury material to be provided to the defence.

Trump is left with the talentless people who are prepared to sacrifice whatever professional reputations they might have had in order to pleasure the Orange Turd. So it's not surprising that his legal shenanigans are not only barely legal (if at all), but also shoddily done.

If you're going to crime successfully, you need clever people who can do it well.

Next up will be Judge Currie's decision in a joint James Comey and Letitia James hearing, which is due before Thanksgiving. This time consideration is being given as to whether Halligan is properly appointed.
Pam Bondi claims she retroactively ratified Halligan's actions having reviewed the grand jury materials, but there is a two hour gap in the transcript material. - Crucially, the two hours before the indictments were agreed.
It looks like the magistrate judge has caught Halligan lying in the evidence provided in the sole Comey case and the indications are both Halligan and Bondi have been less than honest in the Comey/James case.
