The SpaceX Dragon Capsule has been docked for 6 months. It could have been used at any time. Musk made no contact with NASA to suggest an earlier return. NASA agreed with SpaceX that operationally and financially it was better for the two astronauts to integrate into the space station crew until the capsule was due for rotation.

ETA As one of the comments says, making two big enemies in one video is real commitment.

I think that Disney would be more likely to have a viable case of copyright infringement. The Tesla part is all factual, so harder to litigate.
