Hegseth is now obviouisly trying to pin the decision on the admiral in charge of the operation, but there's pretty certainly documentation of the order from Hegseth himself, and the admiral will be taking good advice (he's remained silent so far). If he's well respected by the troops under him, Hegseth's attempt to pin it on him will go down really badly with the armed forces in general.

There have been encouraging noises from Congress that they want to find out how decisions were made, from both Rep & Dem reps on the armed forces oversight committee.

Alina Habba's position as US Attorney for New Jersey is found by a court to be unlawful.
Unlike the recent well publicised Halligan case involving James Comey and Letitia James, this hearing was at appeal court level, with the unanimous decision being writted by a Bush appointee.
“It is apparent that the current administration has been frustrated by some of the legal and political barriers to getting its appointees in place,” Judge D. Michael Fisher, an appointee of President George W. Bush, wrote in the 32-page opinion. “Its efforts to elevate its preferred candidate for U.S. Attorney for the District of New Jersey, Alina Habba, to the role of Acting U.S. Attorney demonstrate the difficulties it has faced — yet the citizens of New Jersey and the loyal employees in the U.S. Attorney’s Office deserve some clarity and stability.”

Habba is the latest, (the fifth I think) regime prosecutor to have been found to not be legally appointed. The next hearing is the appointee for the Northern District of New York, which is due to heard later this week.

The published judgement is one of the most impenetrable things I've ever tried to read (apart from academic sociology bilge). At one point they even get into discussing tenses in English to support their argument about interpretation of one of the statutes and whether it applied at just the point that the post became vacant, or if it was an ongoing period of time. It makes you realise why 'the law' is such an enormous business in the US, and given the size of the workforce needed to deliver it, they've ended up with lawyers who would be better qualified to work in a McDonalds.
