Agreed on the basis of Brexit but this is a wider issue. Side stepping parliament should be a red flag.

But it's not something new in the context of 'dynamic alignment'.

Governments of all stripes have used Henry VIII powers for many, many years.

When I worked for what is now the MoJ we discussed it as part of developing a policy for part of the Court Service in 1998. And it wasn't new then.

Well, in my view it should be stopped otherwise you end up like Trumpistan.

I ageree.
Whilst I am very very in favour of alignment with EU, it just erodes our democratic processes to exclude Parliament from such important decisions. Also, whilst I've not seen any whip assessments of MPs views, given the disaster Brexit has unquestionably cause I'd expect such measures to get passed without too much problem. Even if Starmer has to rely on Lib Dems (and Greens) far more important it's seen as a proper democratic process.

(plus, use Henry the VIII and we'll never hear the end of it from Färage and he will be able to use it to swing some waivering in their support allegiances).

Except the airlines are all in it together, whereas Eurostar have a dedicated system just for them.

This seems to confirm that the likes of Easyjet are at the mercy of whatever system airports end up with, whereas I'm rather assuming that with a dedicated system exclusively for Eurotunnel that they might have some agency/interest in having systems either end that don't significantly impact operations.

I am beginning to think that we will just slowly start to re-integrate in a multitude of ways and that there will be a tacit understanding that we all (leavers and remainers) just accept the process and agree not to really mention it. That way Remainers get a broad sense of being part of the EU without actually formalising it, and leavers get to save face as we all agree not to mention Brexit anymore as though it never really happened.

I could see big problems when it comes to a few big steps that can't be gradually adopted. At some point Freedom of Movement will have to be approved. We could gradually relax immigration from EU but at some point Freedom of Movement will have to be passed into law (and at the moment we, even Labour, are moving in the opposite direction).

We could gradually relax immigration from EU but at some point Freedom of Movement will have to be passed into law (and at the moment we, even Labour, are moving in the opposite direction).

As a Remainer, I am all for “going back in” either by stealth or openly. However, as a prelude to free movement, I think immigration from EU relaxation, would have to be matched by UK to EU movement.

I'm sure it would be. I see a problem in that a lot of ardent "Leave" supporters don't value freedom to visit or migrate to EU countries. Hence introducing it would be seen as a massive negative the arguments only being raised about EU citizens coming to UK (ignoring the benefits they create for our society, economy, etc.).

Also Freedom of Movement is a critical part of the EU Free Trade system. Free Trade cannot really exist without it so as UK moves closer so Freedom of Movement will become an issue sooner rather than later.
