@AuroraSaab Badenoch's message was not about whether separate facilities were legal so much as whether they are required.
I'm not sure how you are getting that reading from the link. It says "Kemi Badenoch MP, is calling on members of the public to send real-world examples of
public bodies –
and those that advise public or private bodies –
that could be wrongly stating that people have a legal right to access single-sex spaces according to their self-identified gender".
That seems a straightforward request for examples of misinformation coming from councils, government depts, schools and colleges, and who is promoting that disinformation to these organisations.
As several employment tribunals have shown, organisations who have followed Stonewall's employment advice have come a cropper.
How do you keep trans people out of their gendered facility and into the one determined by their birth sex?
It's not their gendered facility, any more than an under 18 football team is my
age-ed facility because I identify as 17. Exclusion is only allowed in those circumstances where it is a proportionate response to a legitimate aim - separation
by sex in limited circumstances is one of those cases. As is age appropriate football teams.
How would you stop a 65 year old turning up to play in an under 18's game? You'd make sure everyone knew it was for under 18's. You'd make sure the under 18's knew they could complain if they wished. You'd make sure the organisers knew they were able to exclude by age if they wished. You'd direct the 65 year old to the appropriate provision.
What wouldn't be right would be if Age Concern went round schools, companies, and councils, telling them they have to let a 65 year old play in the under 18's if he or she identifies as 17.
This 'How are you going to stop them?' question is a bit odd. Firstly we manage to stop people doing all sorts of stuff fairly successfully. Second, just because things are sometimes difficult to enforce doesn't mean we shouldn't try.
Perhaps you guys could help by being more accommodating to your non conforming brethren in the male facilities.
