Some intelligent psychology is required when the bully is big enough to flatten you.

That's not the current situation - do you think it is?

This is more like the bully tried throwing some punches, but although they hurt like hell, you're still standing, and the bully is looking much less certain about the situation.

Your description of the current situation could be the result of the application of intelligent psychology. Innit.

The published judgement is one of the most impenetrable things I've ever tried to read (apart from academic sociology bilge). At one point they even get into discussing tenses in English to support their argument about interpretation of one of the statutes and whether it applied at just the point that the post became vacant, or if it was an ongoing period of time. It makes you realise why 'the law' is such an enormous business in the US, and given the size of the workforce needed to deliver it, they've ended up with lawyers who would be better qualified to work in a McDonalds.

Go on, give it a go. https://storage.courtlistener.com/recap/gov.uscourts.ca3.125818/gov.uscourts.ca3.125818.81.0.pdf

Or you can skip to the last paragraph, which kinda says "Go fuck yourselves, losers!"

Setting out their reasoning for the inevitable SC hearing? Thomas, Roberts and Alito are going to have get out the game of Twister anyway. Roberts in particular, when back in 1985 he argued for limiting appointments where there was no Senate confirmation.
Although with this SC the normal rules of black isn't white don't seem to apply.
Also I think this is the first of the appeals hearings against the disqualification of the regime appointed attorneys. So the judgement may have been sending a reasoning message to those appeal circuits which will hear the other appeals, in a more detailed form rather than, "The wannabe dictator can just fuck off because the appointments clause is clearly violated."

Yes, looks like that: they've tried to block any possible re-interpretation of statute and precedent (hence the stuff about present/past tense) by considering every argument in great detail.

I see the lefts Epstein hoax has been dropped faster the a hot potato after Jeffries was found to have taken money from Epstein

Now the new whinging line, is their outrage of drug runners bringing narcotics to the USA is being interrupted.
Is that the pardon he's just given Juan Orlando Hernández, sentenced to 45 years in prison for his role in helping drug traffickers move hundreds of tons of cocaine to the United States. No doubt there's a nice little kickback in it for Trump, maybe a cut of the profits.
