So under new gender recognition laws how long before legal challenges are made to the segregation?

Do you mean the Scottish Bill currently vetoed by the government in London?

If so, please could you explain how it makes a legal challenge to segregation any more likely to succeed than is the case now?

Because of the Haldane ruling.

The Hadane ruling last year said that 'sex' wasn't limited to biological sex in Scottish law. A Scottish GRC changes your legal sex for all purposes.

Currently, under the Equality Act, transwomen with or without a GRC can be excluded from single sex services if appropriate and legitimate because their sex is male. Not all service suppliers choose to use these exemptions but they can if they wish.

If someone's sex is changed for all legal purposes, and your biological sex no longer counts, on what grounds would you exclude someone? It would be sex discrimination to do so in Scotland because 'sex' no longer means biological sex.

"For single sex services and jobs, where the exceptions do apply, the judgment means the holder of a GRC that certifies them as female can only be excluded based on gender reassignment, not on their sex, even though their biological sex is the reason for their exclusion. This makes using these exceptions more complex and daunting".

It puts more pressure on service providers to not use the EA exemptions in case they are sued.

None of the 3 held in Limerick last year were arrested for prostitution. Look at the court reports. One was a Brazilian prostitute married to an Irish man. They were convicted of possessing thousands of child abuse photos. Since released I understand.

You might want to correct the Irish Minister for Justice too. He seems to think they are in the women's jail.

The danger to women is reduced because they are so dangerous they are accompanied by guards all the time. Why you think this is some winning argument I can't imagine. 'They are so dangerous they can't be allowed out unaccompanied, therefore they aren't actually dangerous because they can't be allowed out unaccompanied ....'



Then they'd be better off in the male estate where they wouldn't be considered so dangerous then and could socialise unrestricted.



What makes a person campaign so vigorously to place men in women's jails when we all know it's a terrible idea? It's because if they aren't in the women's jail it proves they aren't really women. Which means no transwoman is really a woman.

I think you are an alarmist and something of an idiot to allow yourself to be sucked into this conspiracy theory, and for using the same tactics of alarmism as has also been seen historically in fascism. It doesn't matter how often you use this device, the falsehood of it is blatant.

However you try to cut it, in the RofI trans woman prisoners are not a danger to other prisoners are they, because due to risk assessment they are locked up in isolation for 23 hours each day. In the one hour they are out of their cell they are accompanied, they eat, shower, make one phone call and are returned to their cell.

Female prisoners have more chance of being raped by a prison guard than a trans woman - not that I'm claiming that is happening in Limerick prison.

Yet I'm sure you'll just keep on banging that alarmist drum.

And you think this is humane treatment that could not be challenged in a Court of Law on the basis that as they have a GRC they are a biological woman and therefore entitled to all of the rights that other women have? How many other women are treated like this?

So if trans women are women, shouldn't you be rightly appalled by their treatment? If not, then presumably you are not counting them as women?

I think we may have reached "all women are equal but some women are more equal than others"...

Again, this is just a ridiculous argument. 'They aren't a danger because they are so dangerous they have to have 2 guards with them if they leave their cell..... therefore they aren't a danger....' . It's an utterly bonkers argument for placing transwomen in the female estate. It's a very good argument for placing them in the male estate though, where they can have more freedom and women will be safe. Thanks for making it for me, several times over.
