To further strengthen these protections, the Government have also tabled amendments which will ensure that the qualifying period for unfair dismissal protections can be varied only by primary legislation and that the compensation cap for claims will be removed. That will remove both the 52 weeks’ pay and the £118,223 cap. In practice, few awards get anywhere close to these caps, with the median average award for unfair dismissal being £6,746 in 2023-24. Removing the cap would not impact the methodology for how an employment tribunal calculates these awards.

Had a flick through Piers' Twitter while I was listening to the coverage of this on 5 Live when he claimed it wasn't being discussed earlier, including a message from Starmer, who realistically can do nothing until the full situation is understood.

I wonder if he knows how scheduled Tweets work, or that Starmer's wife is Jewish and his kids are being raised as such.

Probably, but why let that get in the way of his rent a gob status?

Correct. My interpretation of removing the cap is to create fairness in a limited number of situations where an employee is compromised to an extent that cannot be reflected by a 12m salary limit, but who does not fall under a protected designation. One example might be if they have been forced to relocate somewhere remote at great expense, and are sacked unlawfully where there is no alternative employment.

There is also an argument that it would lessen the need for claimants to try to shoehorn a claim into one of the categories that are currently uncapped.

The discussion of whether it's been properly consulted upon is distinct from whether or not it is a good idea.
