But in fact it is very very American. They do overkill in deterrent fines so it is nothing at all unusual.
Although in this case, I think the overwhelming majority of the fiscal penalties are disgorgement.
The claim originally submitted by the New York AG Letitia James, was updated during the course of the trial to $370m. This was based upon profit realised from a couple of deals, the benefit Trump gained from interest rate savings and bonuses paid to key employees who were part of the fraud.
Trump's prospects at appeal, were he to make a bond, would also appear to be low. Although publicly he has railed against the law and claimed it has never been used before, he is once again lying. Most recently against Martin Shkreli, who lost on appeal.
Trump has also failed to get this into Federal Court, so that route is also blocked.
Next up for Letitia James is the National Rifle Association, which if successful could put that organisation out of business.
