Special Counsel Jack Smith has filed an opposition to Trump's appeal against Judge Tanya Chutkan's ruling denying presidential immunity.
But he has also aggressively sought to skip the appeal court ans filed for an expedited hearing in the US Supreme Court, to decide if Trump's actions in contesting the election results formed part of his presidential duties.

Seems like a risky tactic considering the make up of the Supreme Court and some of their previous decisions.

Agreed, but it is a way to try to kill Trump's "presidential immunity" delay tactics.
Since my posting, the Supreme Court has agreed to consider the expedited hearing and has asked for a response from Trump by 20 December. It doesn't mean they will take it, but it's a win to the extent they haven't smacked Jack Smith's petition straight out.
Smith also submitted a motion to the DC Court of Appeal to have Trump's appeal to that body dealt with swiftly and that too has produced a response. The Court wants Trump's response to the motion submitted by 10am Wednesday 13 December, with Jack Smith's team having to respond to Trump's response by Thursday 14 December. It doesn't mean that the DC Court of Appeal will take an expedited appeal, but at least shows they are open to the idea.

Trump will be desperate to have "presidential immunity". It looks like the special prosecutor Jack Smith has accessed phones used by Trump on 6 January. Smith has timely submitted to the Washington DC court, his list of expert witnesses. Three witnesses are referred to, and Smith has put as witness 3, an expert who extracted and processed data from phones used by Trump and another defendant. https://lawandcrime.com/high-profil...luding-when-his-twitter-application-was-open/

The other point about trump is that he would love to get the range of things covered by the immunity extended - as it seems to have never been defined

So that, if he gets elected again, he knows how far he can go in his revenge tour and not get himself into trouble
clearly getting other people into trouble - or prison - is not important - he just wants to know he will be OK (and maybe a selected one or two children - maybe - if they are good)

There will be no limits if Trump succeeds in what he claims about presidential immunity. He would be a dictator. This has been bluntly stated in an amicus brief submitted by a number of prominent Republicans from 5 previous Republican administrations, to the DC circuit Court of Appeal.

Trump loses his claim to presidential immunity in the appellant court, with regards to the second E Jean Carroll defamation case. This time thanks to a screw up by one of his lawyers, Alina Habba*.
https://abcnews.go.com/Politics/don...jean-carroll-case-clearing/story?id=105625015
The judge having already determined defamation has taken place, it's now up to a jury to decide in mid January 2024, what size cheque Trump will be writing.
*This is the same lawyer who, along with Trump, is required to pay damages to Hilary Clinton and others for frivolous lawsuits. Who failed to timeously ask for a jury trial in the New York fraud trial which is about to conclude. And is potentially facing a misconduct hearing, if recent allegations concerning covering up sexual misconduct at Trump's Bedminster golf course are proved.

Strange how people who are around Trump all seem to end up in the poo.

Rudy Giuliani ordered to pay $148 million to two election fraud victims by a US judge.
I was wondering about that. I don't think he's worth anywhere near that amount in terms of his assets and bank accounts - so how is it that it gets paid? Are they assuming that rich friends will bail him out?

My guess is that he won’t pay, just like Alex Jones who was fined $1.5 billion, and hasn’t paid up.
Jones was refused bankruptcy, but so what, as he hasn’t got the cash to pay, so will pay in dribs and drabs until eventually people give up pursuing him.
It does look a bit silly when US juries award damages which can never be paid.

Will Trump bail him out? He has two hopes.
Utter stupidity on Giuliani's part, from start to finish. Getting involved with Trump was bad enough, although seeing his behaviour in Borat and the more recent claims concerning sexual behaviour, he and Trump have more than politics in common.
Then compounding matters by essentially putting two fingers up to the two election workers before they commenced formalities, constantly delaying and not complying with the court process leading up to the hearing and then the court hearing itself with claims he was going to testify, then not doing so. Staggering.
He could have settled this for much less, had he been less of a d1ckhead. Sure, it could still have been a financial wrecking ball, but he's now got hit with this much larger sum, on top of the $1.3m or so due to his former lawyer.
And I think he will find appealing the jury's verdict difficult. I believe to lodge an appeal, a sum or bond equivalent to the damages has to be posted with the court. But he has failed to provide financial information as part of the court process. So if he posts a bond, it tells Shaye Moss and Ruby Freeman, there is money to go after. If he doesn't post a bond, his lack of cooperation with the court process, suggests he has things to hide.
It will be interesting to see if the jury in the E Jean Carroll second defamation hearing due in January, take note and smack Trump with a sum much larger than the $5m awarded in the first defamation hearing.
